The High Court Registries (Amendment) Rules, of 2021 (the HC Amendment Rules 2021) has, in addition to the existing sixteen (16) High Court Sub-Registries established under the High Court Registries Rules, 1971 as amended by the High Court Registries (Amendment) Rules, of 2019, established two (2) new High Court sub-registries in Morogoro Region and Temeke District in Dar es Salaam. The 2 new sub-registries have been established in accordance with the following Orders: –
- The High Court (Morogoro Sub-Registry Establishment) Order, G.N. No. 633 of 2021
- The Order has established the High Court Sub-Registry of Morogoro for the purpose of ensuring speedy and effective trials of civil and criminal cases.
- The Judicature and Application of Laws (One-Stop Judicial Centre of Temeke) (Establishment) Order, G.N No. 640 of 2021:
- The order has established the One-Stop Judicial Centre of Temeke at Temeke High Court Sub Registry for the purpose of ensuring speedy and effective trial of probate and administration causes and matrimonial matters originating from Dar es Salaam Region.
Essentially, the HC Amendment Rules 2021 have made changes to the Jurisdiction of the High Court Dar es Salaam Registry which covered Dar es Salaam, Morogoro and Coastal Regions. With the 2 new establishments, the High Court in Dar es Salaam (Main Registry) will no longer entertain civil and criminal matters originating from Morogoro region where the new High Court Morogoro Sub Registry is now established.
In addition, all probate & administration and matrimonial causes are now to be commenced at the Temeke High Court Sub Registry and no longer the High Court Dar es Salaam Main Registry.
